How Chapter 7 Works in New York
Chapter 7 is sometimes referred to as “liquidation” bankruptcy, but for many people in New York, exemptions mean there is little or nothing to liquidate. When used correctly, Chapter 7 bankruptcy NY exemptions often protect the assets you rely on every day.
Here’s the typical path we walk with you:
- Initial Filing and Automatic Stay: You file your petition. This triggers the automatic stay, which immediately stops collection calls, lawsuits, and wage garnishments.
- Appointment of a Trustee: A bankruptcy trustee reviews your case and evaluates whether you have any non-exempt assets.
- Meeting of Creditors (341 meeting): About 30–45 days after filing, you attend a brief meeting where the trustee asks questions about your finances under oath. We can prepare you in advance so you feel at ease.
- Exemption Review: The trustee evaluates your property and the Chapter 7 bankruptcy NY exemptions you’ve claimed to determine what is protected.
- Discharge of Debts: In most cases, eligible debts are discharged about three to four months after filing.
- Personal Property: Clothing, household goods, basic furnishings, and appliances up to specified caps. Health aids and medically necessary equipment are fully exempt. Additionally, food and fuel for 120 days and up to $1,000. Think of this as a safeguard for dignity and stability—you keep what you need to live and work.
- Vehicle Exemption: Equity in one motor vehicle up to $4,825. A higher amount (often up to $11,975) if the vehicle is equipped for a disability
- Retirement Accounts and Pensions: Most tax-qualified retirement accounts, including 401(k) and 403(b) plans, are fully protected. IRAs and Roth IRAs are protected up to a high statutory cap. Public employee pensions and Social Security benefits are also generally protected.
- Tools of the Trade: Tools, equipment, books, and professional materials necessary for your trade are protected for up to $3,000.
- Public Benefits and Insurance: Workers’ compensation, unemployment, certain disability benefits, Social Security, and veterans’ benefits are usually protected. Support payments needed for you or your dependents, such as child support and alimony, are also protected (ARTICLE 10-A Personal Bankruptcy Exemptions § 282.2).
- Wildcard Exemption: The New York wildcard exemption is a bankruptcy tool that allows you to protect up to $1,100 in any property plus up to $11,825 of any unused homestead exemption.
We are ready to help you list every asset, value it correctly, and claim the most favorable exemptions. A careful and honest approach can ensure that you keep what the law allows.
Eligibility and Strategies to Maximize Your Exemptions
Eligibility and timing matter. We can make sure you qualify for Chapter 7 and that your exemption plan is as strong as possible. For example, to use New York’s exemptions, you need to have lived in New York for at least 730 days (two years) before filing. If not, you may need to use the exemption laws from your previous residence during the lookback period. We can confirm which rules apply.
Once we confirm eligibility, we work with you to maximize the value of Chapter 7 bankruptcy NY exemptions.
-
Inventory: We can document everything you own, from your home and car to household goods, tools, and digital assets.
-
Choose Exemption System: Additionally, we can help you select the exemption system that better suits your needs, whether it’s state or federal. For example, federal law provides bankruptcy exemptions with a cap of $31,575 for equity in a home, as of April 2025. Sometimes the federal wildcard is more helpful if you rent and have modest personal property. Other times, New York’s homestead is the deciding factor if you own a home in a county with a high cap. We can model both approaches before recommending a path forward.
-
Timing: If you expect a tax refund, bonus, or other lump sum, we discuss whether to file before or after you receive it. A few weeks can make a big difference in protecting cash with Chapter 7 bankruptcy NY exemptions.
-
Pre-Filing Planning: We may advise you to pay down secured, exempt debt (like a mortgage) rather than unsecured debt that would be discharged. We are ready to explain actions to avoid, such as last-minute transfers or repayments to family, which can be considered fraudulent. Underreporting (hiding assets) or overvaluing a property can also lead to legal problems, including denial of discharge and criminal prosecution, which may result in up to 5 years in federal prison (18 USC Chapter 9).
